EMERGENCY CLOSURE


Pursuant to 16 USC § 551 and 36 CFR § 261.50 (a) and (b), the following acts are prohibited on the National Forest System lands and road within the Diamond Lake Ranger District (Umpqua National Forest) that are described below and shown in Exhibit A. This Order will become effective on April 19, 2024, and will remain in effect until April 18, 2026, unless rescinded sooner.

PROHIBITIONS:
1.Being in the area after sundown and before sunrise. 36 C.F.R. § 261.58(l).
2.Camping. 36 C.F.R. § 261.58(e).
3.Parking or leaving a vehicle in violation of posted instructions. 36 C.F.R § 261.58(g).

OVERNIGHT USE AND CAMPING CLOSURE AREA: The boundary of the closure area begins at the intersection of Forest Service Road (FSR) 3401 and FSR 3401-010, continues east along FSR 3401 to the unnamed drainage ¼ mile east of FSR 3401-200, then following that drainage continues northwesterly to FSR 3400-101, then continues southwesterly along FSR 3400-104 and the powerline corridor (cleared of trees and including FSR 3400-104 and FSR 3401-010) to its starting point, as shown on the attached map; see Exhibit A.

ROAD AND AREA CLOSED TO PARKING: FSR 3401, including 300 feet on either side parallel to the centerline of the road, from the intersection of FSR 3401 and FSR 3401-010, east along FSR 3401 to the Loafer Creek crossing west of the Winter Night Camp, as shown on the attached map; see Exhibit A. The Umpqua Hot Springs Trailhead Parking Lot remains open for parking from sunrise to sundown.

EXEMPTIONS:

Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this order:
1.Persons with Forest Service Permit No. FS-7700-48 (permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this order.
2.Any Federal, State, or local officer, or member of any organized rescue or fire fighting force in the performance of an official duty.
3.Persons operating over-snow vehicles.

This prohibition is in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.

Violation of this prohibition is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both (16 U.S.C. § 551; 18 U.S.C. §§ 3351, 3559, 3571, and 3581).
